Terms of Service & License Agreement

1. Acceptance of Terms

These Terms of Service and End User License Agreement ("Terms" or "Agreement") constitute a legally binding agreement between you ("Licensee" or "User") and DomainCatchPro ("we," "our," or "us"). By downloading, installing, purchasing, or using any edition of the DomainCatchPro desktop software (OnlineNIC Edition, GoDaddy Edition, ResellerClub Edition) or accessing domaincatchpro.com, you signify your agreement to be bound by these Terms. If you do not agree to these Terms, do not install or use the software.

2. Software Description & Operational Scope

DomainCatchPro is a native Windows desktop client application that interfaces directly with official domain registrar APIs (specifically OnlineNIC EPP socket, GoDaddy Developer REST API, and ResellerClub HTTP REST API) to automate domain registrations and monitor real-time availability.

Operational Scope & Input Specification: The software is engineered as a focused, high-precision desktop client designed to monitor and automate registration for a single target domain name at a time. It is not designed or supported as a bulk multi-domain queue or batch domain scraper.

3. License Grant & Node-Locked Restrictions

A. Perpetual Single-Seat License Grant

Upon payment of the applicable one-time license fee, DomainCatchPro grants you a non-exclusive, non-transferable, perpetual license to install and execute the software on one (1) physical Windows computer identified by the unique Machine ID submitted during checkout.

B. Free Evaluation Mode

Each software installer includes a Free Evaluation Mode by default. Evaluation Mode allows you to install the application, verify system compatibility, test your registrar API credentials, and perform manual lookups without charge.

C. License Transfers & Hardware Upgrades

If you replace or upgrade your physical computer, you may request a one-time license re-issuance to your new hardware identifier by contacting customer support with your original order receipt and new Machine ID. We reserve the right to verify reasonable ownership and prevent license abuse.

D. Use Restrictions

You agree that you will not, directly or indirectly:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the software or its cryptographic licensing algorithms.
  • Sublicense, lease, rent, redistribute, or share your Pro license keys with third parties.
  • Bypass, alter, or disable any security features or offline cryptographic verification mechanisms.
  • Use the software in any manner that violates applicable registrar terms, ICANN regulations, or local and international cyber laws.

4. User Responsibilities & Registrar Accounts

To utilize DomainCatchPro, you must have an active, verified account in good standing with the respective registrar (OnlineNIC, GoDaddy, or ResellerClub) and maintain adequate deposit funds or pre-authorized billing to cover registry and registrar wholesale fees.

  • API Credentials: You are solely responsible for generating, safeguarding, and configuring your official registrar API keys, secrets, usernames, and passwords.
  • Rate Limit Compliance: You agree to configure polling cadences that comply with your registrar's official API quota and rate-limiting policies.
  • Trademark & Intellectual Property Rights: You are exclusively responsible for the domain names you choose to target or register. You represent that your registrations do not infringe on the trademarks, copyrights, or legal rights of any third party.

5. No Guarantee of Domain Registration Success

Domain registration involves complex, millisecond-level interactions between your computer, your registrar's API servers, and central domain registries (e.g. Verisign for .com).

Performance Disclaimer: DomainCatchPro cannot and does not guarantee that any particular domain name will be successfully registered. Registration success is influenced by factors beyond our control, including network transmission latency, registrar queue processing, prepaid account balances, third-party registrar backorder auctions, and registry availability. DomainCatchPro is sold as a software automation tool, not as a guaranteed domain acquisition service.

6. Payments, Taxes & Merchant of Record

All commercial software license purchases are processed through our authorized Merchant of Record (such as Gumroad, Paddle, or FastSpring). The Merchant of Record is the merchant of record for payment processing, tax calculation, collection, and compliance with regional VAT, GST, and sales tax regulations.

7. Refund & Cancellation Policy

We want you to be completely satisfied with your software purchase:

  • Try Before You Buy: We provide fully functional Free Evaluation Mode installers for all editions so that you can verify compatibility with your Windows environment and test your registrar API credentials before paying.
  • Digital Goods Policy: Because software license keys are cryptographic, node-locked digital goods that are delivered instantly upon purchase, sales are generally final once a key has been fulfilled.
  • Defective Software Guarantee: If the software experiences a verifiable technical defect or failure to activate on supported Windows hardware, and our support team is unable to resolve the issue within fourteen (14) days of your report, a 100% refund will be issued via our Merchant of Record.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOMAINCATCHPRO IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, BUG-FREE, OR COMPATIBLE WITH FUTURE UNANNOUNCED CHANGES TO THIRD-PARTY REGISTRAR APIS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DOMAINCATCHPRO, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DOMAIN NAMES, LOSS OF BUSINESS OPPORTUNITIES, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC SOFTWARE LICENSE IN DISPUTE.

10. Modifications & Governing Law

We reserve the right to modify these Terms at any time by publishing updated terms on domaincatchpro.com. Continued use of the software after such updates constitutes your acceptance of the revised Terms. These Terms are governed by and construed in accordance with the laws applicable to commercial software licensing, without regard to conflicts of law provisions.
